General Conditions
Tuscany Quintessence is a Tour Operator based in Florence, legally operating (application num. 15235/2018/SUAP). Legal address is Via G. Romagnosi, 20 – 50124 Florence.
Liability
Tuscany Quintessence has the obligation to choose all services carefully and to prepare the tour in the best way possible. In the unlikely event that services are not fully carried out due to an error through Tuscany Quintessence, we reserve the right to provide equivalent services in compensation. In this case, further damage claims will not be accepted. Subject to this settlement, in case a breach of contract is committed the direct liability of Tuscany Quintessence for immediate loss or injury to the client subsists, provided that the breach was not caused by force majeure or the behavior of the client or a tour participant, and that it is a question of the non-performance of a promised service or an alteration of services which has less value than the service agreed upon in the original agreement. The amount of this liability is restricted by the sum of the agreed cost of the tour.
Furthermore, the providers of the various services are basically personally liable to the client, in case the services are not being carried out in a satisfying way or to their full extent, contrary to the expectations. The liability of the individual companies contracted by Tuscany Quintessence for the purpose of organizing a tour, depends on the appropriate laws of the general conditions of business, on the contract obligations and on common usage.
Any arising complaints must be directed to Tuscany Quintessence immediately and confirmed in writing. In case complaints cannot be solved on the spot, they must be directed to Tuscany Quintessence in writing within 30 days after the termination of the tour. Later claims cannot be taken into consideration.
Tuscany Quintessence will not be liable if any additional expenses are incurred through delay, accident or disruptions of planned itineraries beyond our control, e.g., terrorist activity, strikes, natural disasters, adverse weather conditions, fire, technical problems of transport, closure of ports or airports, cancellation or changes of schedule by scheduled airlines, or similar events beyond our control. Such expenses are the responsibility of the customer.
Tuscany Quintessence is not liable for personal injury, death, damage to property or other loss whether arising from accident (including third parties and equipment), cancellations, delays or any other situation that may arise. Tuscany Quintessence customers should insure against all such possibilities.
We reserve the right to cancel or change any tours without penalty in case of circumstances beyond our control or for any other reason including when the minimum number of participants as specified in the tour program is not reached, or if the tour is not available on the dates requested. In these rare instances, alternative dates/tours or activities may be suggested but if the client does not wish to avail of the alternatives presented, s/he will be fully reimbursed only for the cost of the services paid to Tuscany Quintessence. Tuscany Quintessence is not responsible for additional expenses that may be incurred by a client in relation to a tour cancellation, such as transport or accommodation costs etc.
Privacy policy and On-line security
For the establishment and execution of the contract with you, our organization comes into possession of some of your data, also acquired verbally, qualified as personal by the European Regulation 2016/679 (GDPR). According to the law, this treatment will be based on principles of correctness,
lawfulness, transparency and protection of your privacy.
Your personal information will not be sold or shared, and your e-mail address will not be forwarded to outside parties.
Tuscany Quintessence does not collect or record any credit card details you may provide when purchasing products from our website.
Tuscany Quintessence makes every effort to be precise, but we do not assume responsibility for the statements contained in any other site that offers our tours / services.
Tour Policies
By booking any tour or service, you agree that all participants read the tour description and accept all terms and conditions, as well as any additional requirements that may appear with the individual tour or product descriptions, such as the minimum numbers required for the tour, organization of tours,
climatic limitations etc. Instructions for bicycle use (muscular or electrical bikes) is assumed and not provided, and all customers assume all risks associated with the activity they have booked. Customers affirm they are familiar with multi-speed bicycle.
By booking a package with Tuscany Quintessence you affirm that you are in good health and are physically capable of engaging in the activity you are booking and that you are free from any disturbance that can be exacerbated by intense activity and atmospheric conditions, including high humidity and heat.
Tuscany Quintessence will provide guests with equipment that will be delivered in perfect working condition and which must be returned by the guest in the same working condition at the end of the tour. Participants will be held responsible for any damage to the equipment provided to them by the Company.
Helmet use is essential and not optional.
Tuscany Quintessence reserve the right at any time to substitute alternative accommodation or to make any other alteration to the tours which become necessary due to circumstances beyond our control and undertake to inform participants as soon as possible.
You must be at the meeting point 15 minutes before tour or service departure. We are unable to delay departure due to late arrivals and we reserve the right to cancel your reservation if you do not arrive at the allocated meeting point for the stated departure time.
If you are travelling with children aged under 12 years, please contact us in advance with ages and heights; we will do our best to accommodate your needs.
All tours will be conducted in English. Please contact us in advance in case you have a different requirement. We will do our best to accommodate your needs.
Confirmation
Reservation is only confirmed upon receipt of full payment.
Cancellation penalty charges and re-booking
Customer may cancel the tour prior to departure in accordance with the following rules:
Any cancellation requested more than 30 days prior to departure, will result in 20% cancellation fee plus any non-refundable costs incurred (such as museum tickets and other services charges). In alternative we offer the following options with 10% re-booking fee:
– moving the tour on another day (to be agreed, space permitting);
– take a voucher for the tour that is transferable to a third party;
– joining an alternative activity of equivalent value;
In the case of cancellation between 30 and 15 days prior to departure, cancellation fee is 40% or 20% re-booking fee (as mentioned above).
In the case of cancellation within 14 days prior to departure or no-show, 100% of the tour price/service fee will be forfeited.
No refunds will be provided to clients who cannot complete the tour for health or fitness reasons, nor to those who lose the tour group/guide.
Cancellations must be requested via email.
Governing law
These terms and any dispute or claim arising from or in connection with it or its object or its formation (including disputes or non-contractual claims) will be governed and interpreted in accordance with Italian law and the parties irrevocably submit to the exclusive jurisdiction of the Italian court. In the event of a dispute, the communication must be provided in writing within seven days from the date of the service provided.
